1. Acceptance of Terms
By accessing or using the einvite platform, website, or any related services (collectively, the "Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with any part of these Terms, you must not use the Platform.
These Terms constitute a legally binding agreement between you ("User", "you") and einvite ("we", "us", "our"). We reserve the right to update or modify these Terms at any time. Continued use of the Platform after any changes constitutes your acceptance of the revised Terms.
2. Description of Service
einvite is a digital platform that allows users to create, customize, and share digital invitations for events including weddings, christenings, birthdays, and other occasions. The Platform provides digital invitation creation tools, RSVP collection, guest management, shareable event links, and downloadable printable files.
einvite is a software-as-a-service (SaaS) platform. You are purchasing access to a digital experience, not a physical product, downloadable design asset, or transferable file outside the scope defined in these Terms.
2.1 Event Expiry & Feature Deactivation
All events created on the einvite Platform are subject to an automatic deactivation policy. Specifically:
- All event features, including the shareable guest link, RSVP collection, and event page visibility, will be automatically disabled 30 calendar days after the event date as specified by the user at the time of creation
- After deactivation, guests will no longer be able to access the event page or submit RSVP responses via the shareable link
- The event may remain visible within your account dashboard for reference purposes, but no active features will be accessible to guests after this period
- einvite accepts no liability for any inconvenience resulting from the automatic deactivation of an event, as this policy is clearly communicated at the time of event creation
- It is your sole responsibility to export or record any RSVP Data before the 30-day post-event deactivation date, as einvite does not guarantee access to this data after deactivation
einvite does not offer extensions to the deactivation period, and no refund or compensation will be issued as a result of event feature deactivation.
3. Intellectual Property & Design Rights
3.1 Platform Ownership
All designs, templates, graphics, visual elements, and the overall aesthetic of the einvite Platform are the exclusive intellectual property of einvite and are protected by copyright, trademark, and applicable intellectual property laws.
3.2 What You Purchase
When you subscribe to or purchase a plan on einvite, you are not purchasing or acquiring ownership of any design, template, or visual asset. You are purchasing access to a digital experience built upon our proprietary designs. Specifically:
- You receive a limited, non-exclusive, non-transferable license to use our designs solely within the Platform
- You may not download, export, reproduce, copy, resell, or redistribute any design or visual asset from the Platform beyond the Printables explicitly included in your plan
- You may not use our designs outside of the einvite Platform environment
- No design, template, or visual asset is transferred to you under any purchase or subscription plan
3.3 User-Provided Content
You retain ownership of any text, photos, or personal information you input into the Platform ("User Content"). By uploading User Content, you grant einvite a limited license to display and render that content solely for the purpose of generating your digital invitation.
3.4 Prohibited Actions
You expressly agree not to:
- Reverse-engineer, decompile, or extract any design asset from the Platform
- Use screenshots or screen recordings of designs for commercial purposes
- Claim ownership of or register any einvite design as your own intellectual property
- Recreate or imitate our designs for commercial distribution
4. Printable Downloads & Format Policy
4.1 Printable File Availability
Certain einvite plans include access to downloadable printable files ("Printables"). These files are provided in our standard pre-defined formats, ready for personal printing or submission to a professional print shop.
4.2 Standard Formats
All Printables are delivered in our standard fixed formats, which include predetermined dimensions, layouts, bleed lines, resolution, and file type. These formats have been professionally prepared to ensure optimal print quality and compatibility with standard printing services.
4.3 No Custom Format Modifications
einvite does not modify, adjust, or redesign Printable formats on demand. This includes but is not limited to:
- Changes to dimensions or paper size outside our standard offerings
- Modifications to layout, margins, or bleed settings
- Alterations to font sizes, spacing, or structural design elements
- Conversion to non-standard file formats upon individual request
- Custom resizing for specific printing vendors or machines
4.4 User Responsibility for Print Output
You are solely responsible for verifying that our standard Printable formats are compatible with your chosen printing method or service provider before purchase. einvite does not guarantee compatibility with every print shop, home printer, or third-party printing service. We recommend reviewing our format specifications, available on our website, prior to purchase.
4.5 No Refunds for Format Incompatibility
As Printables are digital files delivered immediately upon purchase, einvite does not offer refunds on the basis of format incompatibility or dissatisfaction with the standard format. It is the user's responsibility to review format specifications prior to downloading.
5. Refund Policy
5.1 Legal Basis
This Refund Policy is established in accordance with EU Directive 2011/83/EU on Consumer Rights, as implemented under Romanian law, and applies to all Users located within the European Union.
5.2 Immediate Delivery of Service
einvite delivers the complete digital service to the user immediately upon payment. At the moment of purchase:
- All invitation designs are made available without watermark
- All Printables included in the plan are made available without watermark
- The full Platform experience is unlocked and accessible
By completing payment, the user expressly consents to the immediate performance of the service and acknowledges the loss of their right of withdrawal, in full accordance with Article 16(m) of EU Directive 2011/83/EU.
5.3 No Right of Withdrawal Upon Access
In accordance with Article 16(m) of EU Directive 2011/83/EU, the right of withdrawal is fully forfeited upon payment, as the complete digital service is delivered immediately and without restriction at the moment of purchase. By completing payment, the user:
- Expressly consents to the immediate performance of the digital service
- Acknowledges that they thereby lose their right of withdrawal
- Confirms they have been clearly informed of this condition prior to purchase
This acknowledgement is recorded at checkout via express user confirmation and constitutes a legally binding waiver of the 14-day withdrawal right under EU consumer law.
5.4 Exceptional 24-Hour Refund Window
Notwithstanding Section 5.3, and as a gesture of good commercial practice, einvite offers a strictly limited 24-hour refund window from the moment of purchase, subject to the following cumulative conditions:
- The refund request is submitted to hi@einvite.net within 24 hours of purchase
- The user provides a clear and valid reason for the request
- The user has not downloaded any Printable
- The user has not shared their event link with any guest
- The user has not collected any RSVP responses
If any one of the above conditions is not met, the refund request will be automatically disqualified, as the digital content and service have been fully consumed and delivered without watermark at the time of purchase.
After 24 hours from the moment of purchase, no refund will be issued under any circumstance.
5.5 Non-Refundable Circumstances
The following circumstances do not qualify for a refund under any condition:
- Dissatisfaction with the aesthetic of a design or template after access
- Incompatibility of a Printable format with a third-party print service
- Failure to use the Platform or features within a subscription period
- Forgetting to cancel a subscription before automatic renewal
- RSVP Data loss resulting from user-initiated deletion, edits, or updates
- Automatic deactivation of event features 30 days after the event date
5.6 Auto-Renewal Notice
Where applicable, subscriptions renew automatically at the end of each billing cycle. You will receive a reminder notification at least 7 days before your renewal date. You may cancel auto-renewal at any time from your account settings.
5.7 How to Request a Refund
To submit a refund request within the 24-hour window, contact us at hi@einvite.net including:
- Full name and account email address
- Order or subscription reference number
- Date and time of purchase
- Reason for the refund request
We will process eligible refund requests within 14 calendar days of receipt and return funds to the original payment method.
5.8 Dispute Resolution
If you are unsatisfied with our response to your refund request, you have the right to seek resolution through the European Online Dispute Resolution (ODR) platform, accessible at ec.europa.eu/consumers/odr, or through the competent consumer protection authority in Romania (ANPC — Autoritatea Nationala pentru Protectia Consumatorilor).
6. RSVP Data & User Responsibility
6.1 Data Ownership
All RSVP responses, guest information, attendance confirmations, and related event data collected through your invitation ("RSVP Data") belong to you as the event organizer. einvite acts solely as a technical intermediary to display and collect this data on your behalf.
6.2 User Responsibility for RSVP Data
You are solely responsible for all RSVP Data collected through your event. This includes:
- The accuracy and completeness of guest information
- Complying with applicable data protection laws, including GDPR, when collecting personal data from your guests
- Informing your guests about how their data will be used
- Managing, exporting, and maintaining your own records of RSVP Data
einvite does not guarantee the accuracy, completeness, or availability of RSVP Data at any time.
7. No Backup Policy
7.1 No Backup Guarantee
einvite does not offer, provide, or guarantee any data backup service. The Platform does not automatically back up your invitations, event content, RSVP Data, guest lists, or any other information you create or store on the Platform.
7.2 User Responsibility for Data Loss
You are solely and entirely responsible for any data loss resulting from your own actions on the Platform. This includes, without limitation:
- Deletion of invitations, events, or guest entries
- Editing or overwriting existing content
- Updates that replace or remove previously saved information
- Account deletion or deactivation
einvite shall not be held liable for any loss of data, loss of RSVP responses, or any damages resulting from the absence of a backup system. We strongly recommend you maintain your own records and export your RSVP Data regularly and well before the 30-day post-event deactivation date.
8. Shareable Links & Guest Privacy
8.1 Nature of Shareable Links
When you publish an event on einvite, the Platform generates a unique shareable link that allows your invited guests to view event details and submit their RSVP. This link is technically accessible to anyone who possesses it.
8.2 No-Index Policy
While einvite applies a "noindex" directive to all event pages, instructing search engines not to index them, this does not make the link private, encrypted, or access-restricted. The noindex directive is a courtesy measure and does not constitute a security or privacy guarantee.
8.3 User Responsibility for Link Sharing
You are solely responsible for to whom you share your event link. By sharing the link with any individual, you accept full responsibility for that person's access to the event information contained on that page, including:
- Event date, time, and location
- Personal messages or notes included in the invitation
- Names of hosts and any other details visible on the event page
einvite is not responsible for unauthorized access to your event page resulting from you sharing the link with unintended recipients, the link being forwarded by a guest to third parties, or the link being shared publicly by any recipient.
8.4 Sensitive Information
You are advised not to include sensitive personal information beyond what is strictly necessary for the invitation. einvite accepts no liability for any consequences arising from the inclusion of sensitive data on a publicly accessible event page.
9. Data Protection & GDPR
9.1 Data Controller
With respect to the personal data of your guests collected through RSVP forms, you act as the data controller and einvite acts as the data processor, in accordance with the General Data Protection Regulation (EU) 2016/679 ("GDPR").
9.2 Your GDPR Obligations
As the data controller, you are responsible for ensuring that:
- You have a lawful basis for collecting your guests' personal data
- Your guests are informed about how their data will be processed
- Personal data is not retained longer than necessary
- Guests' data subject rights are respected, including the right to access, rectification, and erasure
9.3 einvite's Data Processing
einvite processes personal data submitted through the Platform solely for the purpose of providing the service. We do not sell, rent, or share personal data with third parties for marketing purposes. For full details, please refer to our Privacy Policy.
10. Limitation of Liability
To the maximum extent permitted by applicable law, einvite shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of RSVP information, loss of revenue, or any damages arising from unauthorized access to your event link, user-initiated data deletion, format incompatibility of Printables, or automatic event deactivation following the 30-day post-event period.
Our total aggregate liability to you shall not exceed the amount paid by you to einvite in the three (3) months preceding the event giving rise to the claim.
11. Account Termination
einvite reserves the right to suspend or terminate your account at any time if you violate these Terms. Upon termination, your access to the Platform and all associated event data will be removed. As stated in Section 7, no backup will be provided upon termination. No refund will be issued upon termination resulting from a breach of these Terms.
12. Modifications to the Service
einvite reserves the right to modify, suspend, or discontinue any part of the Platform at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the service.
13. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Romania and applicable European Union regulations. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Romania, without prejudice to your rights as a consumer under mandatory EU consumer protection law.
